Duties and Responsibilities:Preparation and Research on all Third Party Claims Related Litigation:Conduct research that will provide information in preparation of all matters for trialConsult with client departments/representatives, and witnesses for instructions and documentation for cases to be presented in CourtDraft pleadings to provide clear motivation justification on a particular position pertaining to the case.Mediation Process:All required steps regarding the mediation process, as governed by the amendment to the rules of court, to be taken.Represent the Road Accident Fund on all Third Party Claims Related Litigation Matters:Attend to Court appearances in all allocated third-party litigation mattersEnsure file administration from opening to the conclusion of a legal case including adherence to trial datesHandle appearances at courts, tribunals, mediation hearings and enquiriesCoordinate administrative legal actions to ensure complianceApprove instructions to appoint and instruct expert witnesses. Reporting:Ensure effective and efficient recording of all casesCompile weekly, monthly and annual reportsMaintain trial register Requirements:Experience in a similar position as a Attorney (RAF & Litigation)Four (4) year Degree in Law or equivalentAdmission as an Attorney of the High CourtRight of appearance in the High CourtRelevant 5 years legal experience post-graduation or admission of which 2 years must have been on area of expertise (personal injury litigation) Key Performance Areas:Knowledge of Law of Delict including Personal Injury and Third-Party compensation lawKnowledge of RAF Act of 1996 as amended as well as the RAF Transitional Provisions Act of 2012 and RegulationsKnowledge of Civil proceedings in the Magistrate, Regional and High Courts of South AfricaKnowledge of relevant case law and LegislationSkills to draft pleadings, discovery of documentation on all court processesExperience in civil litigation.
