Duties and Responsibilities: Foreclosure Banking Expertise:
Comprehensive knowledge of foreclosure banking work and a full understanding of SLA.
Legal Documentation:
Ability to draft, sign off, and process all legal documents, including Section 129 Notices, Summons, Affidavits (Rule 46, Substituted Service, Supplementary), Settlement Agreements, and Notices of Bar.
Client Engagement:
Regular communication with debtors, assisting with accounts, and concluding payment arrangements. Responsible for telephonic discussions and negotiations with debtors.
Bank Proposals:
Submission of payment proposals to the bank for consideration.
Case Management:
Handle administrative queries and provide case updates to the bank. Engage with counsel when necessary for guidance and legal assistance.
Court Proceedings Oversight:
Oversee court matters daily, including briefing counsel for Rule 46A applications and confirming availability.
Update the bank with court outcomes, prepare reports, and finalize all set-down matters.
Documentation & Reporting:
Draft necessary affidavits, ensure proper handling of documents (running copies, affidavits commissioned), and prepare spreadsheets with case outcomes for management reporting.
Feedback & Coordination:
Provide real-time feedback to counsel on the day of court matters.
Bank System Proficiency:
Must be familiar with the Banks DM Software for account updates and timely review requests.
Requirements:
Minimum of 2 years post-admission experience.
Experience in home loans litigation or property law is advantageous.
Strong communication and negotiation skills.
Ability to work under pressure and manage a high-volume caseload.
Excellent organisational and leadership skills.
