Job Description

General Description / Job Purpose:



Responsible for the legal management of construction and operation contracts throughout the lifetime of a project, including managing all legal risk pertaining to such contracts.



Oversee contract managers supporting the PCM and O&M teams.



Support the Heads of the Strategic Procurement, PCM and O&M Teams in negotiating all construction and operation agreements prior to Financial Close.



Support the PCM and O&M Teams in enforcing the Employer's rights and actioning the Employer's obligations under all construction and operation contracts after Financial Close and then Facility Acceptance/ Taking Over of the project.




Responsibilities:




Manage a contract management strategy for projects in construction and operation.

Oversee contract managers supporting the PCM & O&M teams.

Support the Heads of the Strategic Procurement, PCM and O&M Teams in negotiating the EPC or OEM Contracts, BOP Contracts, Co-Operation Agreements and O&M Contracts ("the Construction and Operation Contracts") prior to Financial Close.

Aligning the Construction and Operation Contracts with applicable Project Documents prior to Financial Close.

Managing external attorneys in relation to the Construction and Operation Contracts both prior to and after Financial Close.

Providing legal and strategic support to the PCM and O&M Teams in enforcing the Employer's rights and actioning the Employer's obligations under the Construction and Operation Contracts.

Overseeing all legal claims, formal notifications, and litigation arising from the Construction and Operation Contracts.

Regular legal and strategic alignment with legal counsel supporting the Assets Management team responsible for the financial and project documents, in so far as they relate to or impact the Construction and Operation Contracts (and visa versa)



Minimum Educational Qualifications:




Bachelor's Degree In Law

Admitted Attorney



Minimum Previous Experience:




Minimum of five years relevant PQE, preferably in similar roles in construction and/or operations or asset management

Advantageous: Renewable energy/ IPP industry experience

Advantageous: Dispute management and litigation experience

Advantageous: FIDIC experience



Other Skills:

Excellent organizational skills with ability to multi-task

Good investigation capabilities
