Research for submissions/recommendation for Board Level Considerations on instruction of the Legal Liaison Manager
Compiling of national legal statistics and reports for the National Administration Board
Compiling and delivering all Wage andIndependent Board Agendas
Overseeing the drafting of Exemption Certificates
Assessing Provident Fund, Wage Exemption Applications, Appeal Applications received from the Regions
Overseeing Record keeping of the S143 certification process in Northern, Highveld and Free State regions
Service & Filing of Legal Documents where necessary
Drafting and Interpretation of:
Pleadings/Affidavits
Charge sheets for Disciplinary
Correspondence with Employers/Attorneys/Parties etc.
Contracts
Attends hearings; CCMA; DRC (Dispute Resolution Centre) and Court proceedings
External dispute resolution of Council's contractual obligations e.g. AFSA dispute resolution process
Consultations with attorneys/employers/employees etc.
Attend NAB (National Administration Board) CPO (Committee of Party Officials ) MGB (MIBCO Governing Board) WAGE INDEPENDENT BOARDS as well as INDEPENDENT BOARD in the absence of the Legal Liaison Manager and on instruction
Conducting training
Assessing complex legal matters within the Regions or Shared Service Centre and providing legal opinion
Instructing Council Attorneys on regional collection and execution matters
Attending to litigious matters where the Council is cited
Fielding queries from the Regions/Industry
Maintaining relationships with all external service providers
Maintaining regular communications with the Regions to identify problems within Legal Processes
Maintaining relations with the Parties / CCMA / Labour Court to promote progressive processes within the Council
Required Skills & Competencies
Prior experience with Bargaining Councils preferrable
Excellent legal research and opinion writing skills
Ability to interpret and apply/ enforce the Mibco collective agreements
Excellent verbal and written communication and listening skills
Ability to build strong effective relationships with all stakeholders, i.e. existing clients and potential clients as well as internal stakeholders, i.e. colleagues and management
Must have good decision making and problem solving skills
Must have good analytical skills with attention to detail
Strong negotiation and report writing skills.
Excellent administration skills
Excellent organizational and planning skills
Pension Fund Law experience and knowledge
Minimum Qualifications & Requirements/ Experience
Legally qualified with at least a 3-5 year Law Degree
Must be an admitted attorney
Experience in the field of Labour Law as well as Civil Law, with Labour Law knowledge specifically with regards to Bargaining Councils and collective agreements would be an advantage
Sound knowledge of and experience of the dispute resolution process, including alternative dispute resolution.
Knowledge of civil procedure and labour forums essential
