It will be your responsibility to assist me, as the Mine Manager appointed in Section 3(1) of the MHSA in the carrying out of my duties and responsibilities within your area of responsibility.2. In this capacity you will be responsible for the day-to-day management and operation of activities within your designated area of responsibility. It will be your responsibility to ensure compliance with the provisions of the MHSA, MHSA Regulations and the Minerals Act Regulations which remain in force and effect in terms of Schedule 4 of the MHSA (as amended or replaced from time to time) insofar as it relates to the manager as defined, and as applicable at the mine through the application of your skills.3. Experience, knowledge and training. You are required to ensure that the duties of the manager as set out in the MHSA and Regulations are complied with.4. Without limiting the general nature of your duties set out above, you are required to the extend reasonably practicable to:5. Take all steps to ensure that all persons under your charge are fully conversant with the provisions of the MHSA, MHSA Regulations and the Minerals Act Regulations which remain in force and effect in terms of Schedule 4 of the MHSA as amended or replaced from time to time, and to enforce the provisions of the MHSA and Regulations.6. Observe and enforce any codes of practice, any instructions, procedures, directive, permissions, exemptions etc. issued by the mine, the DMRE or any other person who is authorized to do so. Ant further clarification regarding the interpretation of the MHSA, MHSA Regulations and the Minerals Act Regulations, which remain in force and effect in terms of Schedule 4 of the MHSA, coeds of practice, instructions, directions, permissions, exemptions etc. will be supplied to you on request.7. Be responsible for the proper discipline of all persons under your charge.8. Provide and maintain a working environment that is safe and without risk to the health of employees within your area of responsibility.9. Identify relevant hazards and assess the related risks within your area of responsibility, to which persons who are not employees may be exposed and ensure that persons who are directly affected by activities within your area of responsibility are not exposed to any hazards to their health and safety.1. Consider an employees training and capabilities in respect of health and safety before assigning tasks to that employee.2. Provide proper and adequate health and safety training.3. Provide employees within your area of responsibility with any information, Appointment instruction training or supervision that is necessary to enable them to perform their work safely and without risk to health.4. Report any contraventions of the provisions of the MHSA, MHSA Regulations, and the Minerals Act Regulations, which remain in force and effect in terms of Schedule 4 of the MHSA, codes of practice, instructions, permissions exceptions etc.5. Minerals Act Regulation 2.9.2 provides that I may appoint persons as may be necessary to assist me with the enforcement of the Regulations (with reference to the Regulations promulgated under the Minerals Act.)6. You will be appointed to assist me with the enforcement of the Regulations referred to above.7.
